How are the Olympic Properties protected and why is it important to regulate their use?

The Olympic Properties are protected internationally by Intellectual Property (IP) rights, such as registered designs, copyright, trademarks and other rights protecting intangible assets linked to the Olympic Games.

In addition to IP Rights, numerous countries have expressly adopted national legislation protecting the Olympic Properties and giving the IOC and the corresponding National Olympic Committee (NOC) the exclusive right to exploit some of the Olympic Properties in these territories.

In addition, the Nairobi Treaty on the Protection of the Olympic Symbol was adopted in 1981. This obliges each state that has ratified it to refuse or invalidate the registration of a mark and to prohibit the use for commercial purposes of any sign consisting of or containing the Olympic symbol, except with the IOC’s authorisation. Today there are 55 members of the Nairobi Treaty.

In summary, the protection given by the IP and by national and international legislation ensure that use of the Olympic Properties in the market must be authorised by the IOC.

The IOC is a non-profit organisation that uses the revenue generated from the exploitation of the IP rights associated with the Olympic Games to assist athletes and develop sport worldwide and to organise the Olympic Games. As such, protecting the integrity of the Olympic Properties is crucial to the viability of the Olympic Movement. Otherwise, the IOC’s ability to generate revenue would be in jeopardy and, consequently, the IOC’s and the corresponding National Olympic Committees’ support to the sports world would be compromised.

How can I use the Olympic Properties?

In the context of the Olympic Movement’s values and in accordance with the legal standards regarding the use of IP, the IOC has prepared the following material for a better understanding of the use of the Olympic Properties by entities that do not belong to the Olympic Movement and/or are not the current Official Partners, Licensees and Broadcasters.

If, after reading this material, you wish to make a formal request to use the Olympic Properties, please complete this form or contact your National Olympic Committee.

  • What is commercial use? Commercial use means use of the Olympic Properties for the manufacture and/or offer in the market of goods and services for direct or indirect financial gain. Examples of commercial use of the Olympic Properties could be using the Olympic rings for: manufacturing a new line of clothing, offering a trip to the Olympic Games or commercialising merchandising items such as pins, diaries or souvenirs.

What is promotional use? Promotional use means using the Olympic Properties for advertising in the market of the services, goods or activities offered by an entity, regardless of whether there is a financial gain; creating an association with the Olympic Games; or capitalising on their popularity. Examples of promotional use of Olympic Properties could be using the Olympic rings to broadcast or promote an event for fundraising for charitable purposes, special offers in connection with the sale of products or advertising a publication or initiative.

This is fundamental to the generation of revenue for the planning and organisation of the Olympic Games and to safeguarding the goodwill of the Olympic Movement.

Consequently, any request for use of the Olympic Properties with a directly or indirectly commercial or promotional purpose will not be approved.

    • Use the Olympic Properties for any promotional purposes, such as to promote an event (for example on flyers or other promotional material) or any products or services, since this may suggest that there is official IOC endorsement for your activities.

However, factual reference to the athletes and their achievements is allowed provided that this is authorised by the athlete and the concerned NOC.

    • Use the Olympic Properties for artistic works which will be offered for sale.

  • Please do not use the Olympic Properties in connection with any symbols with a political or religious meaning. As indicated in Rule 2 of the Olympic Charter, one of the IOC’s missions is to maintain and promote its political neutrality and to preserve the autonomy of sport.

  • Please contact images@olympic.org regarding the use of Olympic pictures and/or footage. In every case, any use will have to comply with these guidelines and any other IOC applicable guidelines for the use of Olympic pictures and/or footage.
